ESTACADA PLANNING COMMISSION MINUTES
THURSDAY, AUGUST 21, 2008 7:00 PM

1. CALL TO ORDER
The meeting was called to order at 7:00 pm.
2. ROLL CALL
Present: Dennis Anderson, Emil Hnidey, Dave Piper, Tom Sager, Allen Cameron, DCR Hovda, CP Hoelscher.
Absent: Michael Ennis, John James.
3. APPROVAL OF JULY 17, 2008 MINUTES
Consensus was to approve the minutes as presented.
4. PUBLIC HEARINGS
A. Temporary Use Permit #2008-1. The applicants, Robert & Maria Taylor, are requesting a temporary permit to allow the placement of a mobile home on their property to provide for medical care for elderly parents. The property is zoned C-1 (Commercial) and is subject to sections 16.28 & 16.80 of the Estacada Municipal Code. The property is described as 34E, 17, tax lot 700 31332 SE Strubhar Lane.
Chrm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.
Chrm. Cameron read a statement regarding evidence.
CP reviewed the staff report, which recommends approval with conditions.
The Commission discussed the one-year time frame limit and the hardship this places on the applicant. The Commission also discussed how its always hard to tell if the hardship is really being used as a hardship and not just someone else living there. CP stated that is why we have them re-apply each year and they have to provide medical documentation regarding the tenant.
Robert Taylor, applicant, this will allow his mother-in-law in close proximity of them because she needs 24-7 care and his mother is already living with them in their 2 bedroom home. This temporary use will make this a lot less of a burden on them by having her close.
The Commission asked the applicant if the burden of having to re-apply each year would be an issue. The applicant stated the convenience outweighs the fee of re-applying.
Cm. Piper moved to approve Temporary Use Application #2008-1 with the conditions in the staff report. Cm. Sager seconded the motion. Roll Call Vote: Cm. Sager yes, Cm. Hnidey yes, Cm. Piper yes, Cm. Anderson yes, Cm. Chrm. Cameron - yes. Motion passed 5-0
B.
Comprehensive Plan Amendment Application #2008-1
& Zone Change Application #2008-1.
The applicant, William (Adam) Durham, is requesting a comprehensive plan
map amendment from Commercial to General Commercial, and corresponding zone
change from C-1 to C-2 for property described as 34E 20DD, tax lot 7900. This application is subject to the criteria
in section 16.32 & 16.101 of the Estacada Municipal Code and applicable
policies in the City of Estacada Comprehensive Plan. General Location: 34E 20DD, tax lot 7900 S Broadway between
NE 1st Avenue & SE 2nd Avenue. A recommendation on this matter will be
forwarded to the Estacada City Council.
The City Council will hold a public hearing on Monday, September 8,
2008, beginning at 7:00 pm in the Estacada City Council
Chrm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.
CP reviewed the staff report and discussed the recommended conditions of approval. CP also discussed the zone of the area and the current use of the upper ½ of this block, which is all residential. He stated that a commercial use of this small lot would be difficult, therefore he is recommending approval of this application.
Bruce Erickson, Fir Wood Design Group, representing applicant, asked about page 12 stating the criteria is not met. CP stated this is a mistake and should read it is met. Otherwise, Mr. Erickson stated they agree with the conditions of approval and would like to ask the Commission to approve the application.
There was no further public input.
Chrm. Cameron closed the public hearing.
Cm. Piper moved to recommend approval of Comprehensive Plan Amendment Application #2008-1 & Zone Change Application #2008-1 to the City Council. Cm. Anderson seconded the motion. Roll Call Vote: Cm. Sager yes, Cm. Hnidey yes, Cm. Piper yes, Cm. Anderson yes, Cm. Chrm. Cameron - yes. Motion passed 5-0.
C.
Annexation Application #2008-4. The applicants,
Aaron & Charlotte Gant, are requesting annexation of property described as
34E, 21D, tax lots 1100, 1200, 1300, 1701, & 1703 into the City limits of
Estacada. The application includes a corresponding zone change from RRFF-5:
Rural Residential Farm Forest (county designation) to R-1 (low density
residential), consistent with the Estacada Comprehensive Plan. The 25.28 acre
parcels are located on SE Teeples Lane. The application is subject to the criteria in
Section 16.16, 16.101, and 16.124 of the Estacada City Code and applicable
policies in the Estacada Comprehensive Plan.
A recommendation on this matter will be forwarded to the Estacada City
Council. The City Council will hold a
public hearing on Monday, August 25, 2008, beginning at 7:00 pm in the Estacada
City Council

CP reviewed the staff report, which recommends approval with conditions.
Aaron Gant, representing the 5 applicants, stated they understand how far away the services are and acknowledge that they would have to extend them some day. He asked that they approve this application.
Kathry Rhay, 31595 SE Lawrence Road, stated their property abuts the applicants and she does not want the city limits and a new subdivision at her property line. She is concerned with the wetlands and wildlife that would be affected. She also stated that the top part of her driveway is a right of way for access and this might be extended to be the access that future development in this area causing a lot of traffic to go by her property.
Mr. Gant is not proposing any access off of Lawrence Road or anywhere near it. He owns access along Coupland Road, as well as planned access along Independence and another road.
Chrm. Cameron closed the public hearing.
Cm. Anderson moved to recommend approval of Annexation Application #2008-4 to the City Council with the conditions in the staff report. Cm. Piper seconded the motion. Roll Call Vote: Cm. Sager no, Cm. Hnidey o, Cm. Piper yes, Cm. Anderson yes, Cm. Chrm. Cameron - yes. Motion passed 3-2.

D.
Continuation: Land Partition Application #2008-4. The Applicant,
Mark Logue, is requesting a three-lot partition of property described as 34E,
28B, tax lot 2601, which is located at 468 SE 4th Avenue. The subject property is zoned R-1. This
application is subject to the criteria in Section 16.16, 16.104, 16.108,
16.116, 16.120 and 16.132 of the Estacada City Code.
The Commission discussed the options and since they have to make a decision within 120 days from when the application was deemed complete they decided to just move forward and make a decision tonight and put a condition that addresses their concerns.
Cm. Piper moved to approve Land Partition #2008-4 with the conditions in the staff report and with a new condition that the applicant meet the setback standards or apply for a variance. Cm.
